    Let’s look at the facts: Hospitals are increasingly being penalized for the development of hospital acquired infections (HAIs). CMS reimbursement guidelines have changed the game. HAIs have increased the liability of not only hospitals, but also physicians. Seven out of the 17 conditions on the non-reimbursable list relate to infections. We will discuss and review 3 of the events that hospitals are not reimbursed by Medicare and many of the private payors for

    · Catheter-associated urinary tract infections or CAUTIs-most common HAI as reported by the Joint Commission

    · Central line associated bloodstream infection or CLABSI

    · C. Difficile infection

    Starting in 2011, hospital data about infection rates became available to the public. Beginning in 2013, hospitals will have to report health acquired infection rates that were not present on admission. Catheter associated urinary tract infections, the most common event, as well as vascular or central line catheter-associated infection and C-difficile are all reportable events. Mortality rates and the resulting healthcare expense burden have brought national attention to this issue.

    Patients and their families are actively pursuing claims against facilities for contracting hospital-acquired infections. Attorneys and legal nurse consultants need to understand how to evaluate these cases. CAUTI, CLABSI and C-difficile hospital acquired infections are important and timely healthcare safety issues that have caught the attention of both plaintiff and defense attorneys. These types of infections are an urgent issue in part due to healthcare clinician transmission, antibiotic resistance and event mortality.

    The regulations in each state define the scope of practice for the various levels of licensed nurses. The regulations are designed to ensure the public’s safety.
    Since the days of Nightingale, nursing practice has expanded dramatically. The technological exposition, explosion, greater autonomy for nurses, increased demand for cost containment, and better educated patients who have higher expectations in the quality of the healthcare services they receive, have contributed to the expansion.

    Revised national standards of care published by the Case Management Society of America (CMSA) require case managers/discharge planners to advocate on behalf of patients and to respect their rights, including patients’ right to freedom of choice.  Medicare Conditions of Participation (CoP’s) for hospitals and other sources also support this legal and ethical obligation (just like how people support a title 24 report).  This teleconference will educate case managers/discharge planners about this obligation and how to meet it.  What about presenting lists to patients?  What if patients do not choose?  What about doctors who want certain providers to render services to their patients?  Practical ways to comply will be emphasized.

    Objectives:

    • Describe revised CMSA standards applicable to patients’ right to freedom of choice of providers.
    • Identify two sources of patients’ right to freedom of choice of providers.

    About the Speaker:
    Elizabeth Hogue is an attorney in private practice with extensive experience in health care.  Prior to becoming an attorney, she was employed as a personnel manager by a Blue Cross-Blue Shield Plan.  She studied at the University of Maryland School of Law, concentrating in health law, and gained considerable clinical experience, course work, and employment experience in this area.  Following her admission to the Bar, she developed an active practice in health law.  She represents clients all over the country.  Her clients are professional associations, managed care providers, and institutional health care providers; including hospitals, long-term care facilities, home health agencies, durable medical equipment companies, and hospices.  She has also represented a number of individual providers and case managers concerning health-related issues.  Ms. Hogue gives approximately 50 presentations each year on health-related topics, including future trends in the healthcare industry.  Her numerous articles are regularly included in trade association publications and other journals.  Ms. Hogue is a member of the American Health Lawyers Association.  Her offices are located in Washington, D.C.
