Audio-Conference Description
Revised national standards of care published by the Case Management Society of America (CMSA) require case managers/discharge planners to advocate on behalf of patients and to respect their rights, including patients’ right to freedom of choice.  Medicare Conditions of Participation (CoP’s) for hospitals and other sources also support this legal and ethical obligation.  This teleconference will educate case managers/discharge planners about this obligation and how to meet it.  What about presenting lists to patients?  What if patients do not choose?  What about doctors who want certain providers to render services to their patients?  Practical ways to comply will be emphasized.

 

Objectives:

  • Describe revised CMSA standards applicable to patients’ right to freedom of choice of providers.
  • Identify two sources of patients’ right to freedom of choice of providers.

 

About the Speaker:
Elizabeth Hogue is an attorney in private practice with extensive experience in health care.  Prior to becoming an attorney, she was employed as a personnel manager by a Blue Cross-Blue Shield Plan.  She studied at the University of Maryland School of Law, concentrating in health law, and gained considerable clinical experience, course work, and employment experience in this area.  Following her admission to the Bar, she developed an active practice in health law.  She represents clients all over the country.  Her clients are professional associations, managed care providers, and institutional health care providers; including hospitals, long-term care facilities, home health agencies, durable medical equipment companies, and hospices.  She has also represented a number of individual providers and case managers concerning health-related issues.  Ms. Hogue gives approximately 50 presentations each year on health-related topics, including future trends in the healthcare industry.  Her numerous articles are regularly included in trade association publications and other journals.  Ms. Hogue is a member of the American Health Lawyers Association.  Her offices are located in Washington, D.C.
