Cancer remains a significant disease, with over 1,000,000 new cases diagnosed each year in the U.S. Cancer is the second most common cause of death, preceded only by cardiac disease. While many medical advances have been made for the early detection, diagnosis and treatment of various cancers resulting in a significant increase in survival rates and improvement in quality of life, cancer can still kill and is the No. 1 feared medical diagnosis in the country, perhaps the world.
Litigation involving cancer cases is as varied as the different types of cancer that are diagnosed and may include products liability and toxic torts. Medical malpractice can occur anywhere along the continuum of care: failure to appropriately screen for early stage cancers, delays in the diagnosis and multiple complications arising as the result of treatment. The treatment involved in cancer care includes aggressive medical, surgical and radiological oncology practices that carry the risk of significant morbidity as a byproduct of the standard treatment for the best disease-free survival rates, and freedom from recurrence or progression.
